I. Introduction

Present statute (further called „the statute”) describes rules and conditions of placing purchase orders and purchasing commodities at KINGA e-shop (further called the shop).
The shop sells commodities to physical persons (that on the purchase day were 13 years old or older – art. 11-24 of Civil Code. If the condition is not fulfilled the transaction is considered legally non-binding) and Transactors that registered in the Shop’s e-service (further called ”Customers ). Registration is free of charge.
Placing a purchase order by the Customer is tantamount to acceptance of this Statute. Content of the statute constitutes a contract between The owner of the Shop and a Customer using their services

II. Transaction parties

The shop is run by Kinga s.c. Company, located in Bialystok, 6 Tysiaclecia Panstwa Polskiego street, 15-111 Bialystok, POLAND, working on the basis of entry to Business Registry # 65833maintained on behalf of The President of Bialystok. TAX ID: 542-301-39-23, REGON 200121507
Purchase orders can be placed via the website http://www.kinga.com.pl. Only.
The shop trades in:

Lingerie
Accessories and other textile commodities Manufactured by Kinga

Commodities available at the Shop are sold worldwide via the Inernet

III. Purchase orders

Purchase orders are realized under conditions that the purchase order form, available on the Shop’s web page , is filled in properly and that the payment for the ordered goods and freight charges are settled.
Placed purchase order is considered a sell-buy contract according to the Civil Code.
Purchased orders can be placed 24 hours a day, 7 days a week through the whole year.
By placing the purchase order we mean adding products offered by the Shop to the Shopping cart by filing in the “Purchase order form” according to information in it.
The necessary condition for placing the purchase order is having an e-mail account and contact phone number.
In case of lack of possibilty to contact the Customed because of wrong phone number and e-mail address the purchase order will be cancelled within 5 days from the date of purchase order placement.
Every purchase order placed at the Shop is confirmed via e-mail or by a call from an employee of Kinga Company.
Purchase orders placed by 11 A.M. CET are realized within the same day but after confirming purchase order. Purchase orders placed after 11 A.M. CET are realized next day. Purchase orders placed on Saturday, Sunday or holidays are realized on the first working day following holidays.
Soon after placing the purchase order the Customer receives information about receiving the purchase order ( summary of chosen products , delivery address, value of the purchase order, payment method, dispatch method). In case of lack of confirmation the Customer should contact the Shop either by sending an e-mail or by calling. Purchase order paid on receipt must be confirmed within 5 days. Realization of the purchase orders remains withheld until the confirmation is provided. The Shop reserves the possibility of confirming the purchase order by phone. All purchase orders not confirmed on time will be cancelled. Deal between the owner of the Shop (the Seller) and the Customer (the Buyer) becomes valid the moment the purchase order has been confirmed.
The Shop reserves the right to verify the purchase order (after consulting with the Customer) and cancel it in cases raising doubts concerning the realization of the purchase order. In such cases the Customer is notified immediately.
Order reception commences with:
1. In case of purchase orders paid on receipt – after receiving purchase order confirmation via e-mail or telephone,
2. In case of purchase orders via bank transfer or e-transfer – after booking the prepayment on the given bank account of Kinga Internet shop,
3. in case of purchase orders paid with a card – after receiving information about proper card authorization.
Time , after which the ordered products are delivered to the ordering person constitutes of time needed to complete and prepare the dispatch and time needed to deliver the consignment via Polish Post or a courier to a given address.
In case of shortage of products covered by a purchase order the buyer will be informed about that fact by Kinga Internet shop. In that case the buyer has the right to chose the method of purchase order realization (partial realization of available products, extending realization time, purchase order annulment). In case of lack of answer from the buyer within 7 days the shop reserves the right to dispatch only available products covered by the purchase order or to cancel the purchase order.
In case of purchase orders sent abroad the only acceptable payment term is payment in advance.
If the payment is not realized within 14 days from the order date Kinga Internet shop reserves the right to cancel the order.

IV. The Offer

All products offered by Kinga Internet shop are new. The products are covered with the manufacturers warranty or sponsion.
All modifications, changes and mendings done without the consent of Kinga company and damages caused by the Buyer are equivalent to the guarantee and sponsion loss.
Claims emerging from both not knowing and not obeying the statute will not be taken into consideration.
A detailed list of products and their prices is placed on the Shop’s Internet webpage.
All prices indicated on Kinga Internet shop webpages are Gross prices and include the value added tax according to tax rate described by a separate regulation. The price visible by a product at the moment of a purchase order placement is binding for both parties.
The proof of purchase is a receipt or an invoice ( issued on request of the Customer – option available In the purchase order form) sent to the buyer together with together with the purchased goods ( providing Tax ID by the buyer during the registration process entitles Kinga company to issue a VAT invoice without a signature of the Customer).

V. Delivery and reception of goods

The goods are delivered in a way chosen by the Customer and indicated in the purchase order:
1. Via Polish Post – applies to Polish territory only ( delivery time : up to 5 working days);
2. Via a courier ( up to 2 days within Polish territory and 7 working days to other European countries ; in case of other countries the delivery time is agreed on individually with the Customer).
The customer receives an electronic dispatch notification on the day of dispatch.
The shop is not liable for impunctual deliveries realized via Polish Post or a courier and any damages caused by Polish Post or a courier. The Customer is obliged to check the content and condition of the delivered goods on receipt and in presence of a post man or a courier , immediately place a claim to a forwarder and inform Kinga e-shop about the fact. All claims concerning mechanical damages created in transit will be taken care of only after presenting claims protocol signed by the receiver and deliverer of the consignment. RECEPTION OF THE CONSIGNMENT WITHOUT ANY REMARKS IS EQUAL TO EXPIRATION OF ALL CLAIMS ON GROUNDS OF THE CONSIGNMENT DAMAGES. .
We do not provide exact deilivery hour.
Commodities are not delivered on Saturdays, Sundays and holidays.
If a courier finds nobody under a given delivery address a delivery notification should be left.
Courier will retry delivering the ordered goods for next 3 working days from the date of leaving a delivery notification.
Apart from the delivery address the delivery note also contains Customer’s mobile phone number stated during purchase order placement. The number allows the courier to contact the receiver at first delivery attempt. The courier is not obliged to call the receiver at first delivery attempt.
Not receiving the dispatch in the standard storing time ( Polish Post – 14 days from the notification date; courier – 14 days from the notification date – has to be confirmed) will result in charging the Customer with all the costs the Shop bears because of that fact.

V. Claims and returns

According to the Act , dated 02/03/2000 on protection of some of the consumers’ rights and on responsibility for damages caused by dangerous products, the Customer can resign ( on the way of retracting from an agreement ) from the goods bought at Kinga Internet shop without giving the reason, issuing appropriate written statement within 10 days from the date of receipt. The necessary condition for returning the goods is delivery of goods free of any usage signs.
In case of goods return the amount equal to the value of the purchased/returned goods will be transferred on a given bank account number.

VI. Final resolutions

All trademarks and brandnames used in the service, have been used for informational purposes only and are exclusive properties of the companies.
All data provided by the Customer during the registration and placing purchase orders is confidential and used by Kinga company for purposes connected with services and realization of transactions made in the Shop.
The customer gives the consent for processing personal data according to the Act on personal data protection dated 29/08/1997 (Dz.U. 1997 Nr 133 poz. 883 z późn. zm.) Basing on the act all data provided during the registration process can be viewed, modified or removed.
For all issues unsettled in the Statute appropriate regulations of the Civic Code and other acts are applied.
All litigations resulting from the selling contract at the Internet shop will be dealt with the Court of jurisdiction appropriate to the place of residence of Kinga S.C. Dariusz i Kinga Lesisz.
The content of the Statute can be amended. Kinga Internet shop obliges itself to inform the Customer about the amendments in the Statute. Information will be visible for a week on the Statute webpage. All amendments become valid on the day of publishing on Kinga e-shop webpages.
Kinga reserves the right to amend the prices of the commodities from the offer, introduce new models and commodities, start and finish promotional actions and introduce amendments on the webpages.
